BK Music Learning Workshop Participation, Liability & Photo/Video Release
BK Music Learning provides music-based educational workshops, performances, and enrichment programs for schools, libraries, community organizations, and other educational or family-centered settings.
By attending, entering, observing, or participating in a BK Music Learning workshop, program, event, or related activity, each child, participant, parent, guardian, caregiver, school representative, and adult acknowledges and agrees to the terms below.
Assumption of Risk
BK Music Learning workshops may include music, movement, dancing, singing, drumming, physical participation, group activities, and other interactive learning experiences. Participation in these activities may involve certain risks, including but not limited to slips, falls, accidental contact with other participants, minor injuries, or other risks commonly associated with movement-based group activities.
By contracting with, attending or participating, you acknowledge and voluntarily assume all risks associated with participation in BK Music Learning workshops and related activities, whether by an adult participant, minor child, student, or accompanying guest.
To the fullest extent permitted by law, you agree to release, waive, and hold harmless BK Music Learning, Baba Yah, and their respective owners, employees, contractors, instructors, representatives, partners, and affiliates from any and all claims, liabilities, damages, losses, injuries, or expenses arising out of or related to attendance at or participation in a BK Music Learning workshop, program, event, or activity, except in cases of gross negligence or willful misconduct.
Parent, Guardian, School, and Adult Responsibility
For minor children or students participating in a BK Music Learning workshop, the parent, legal guardian, school, organization, teacher, caregiver, or authorized adult responsible for the child confirms that the child has permission to participate in the workshop and related activities.
Parents, guardians, schools, organizations, teachers, caregivers, and accompanying adults remain responsible for the supervision, safety, and conduct of the minor children or students in their care, unless otherwise agreed in writing.
Photo, Video & Media Release
BK Music Learning may photograph, film, record, or otherwise capture images, video, audio, or likenesses of participants during workshops, programs, events, and related activities.
By attending, entering, observing, or participating in a BK Music Learning workshop, program, event, or activity, you acknowledge and agree that you, your child, your student, or any minor child attending with you may be photographed, filmed, recorded, or otherwise captured.
You grant BK Music Learning, Baba Yah, and their authorized representatives the right to use photographs, video recordings, audio recordings, names, voices, images, and likenesses captured during BK Music Learning workshops, programs, events, and activities for lawful business, educational, promotional, marketing, advertising, social media, website, documentation, archival, and publicity purposes.
These materials may be used to promote future BK Music Learning workshops, programs, events, educational offerings, school partnerships, community programs, and related services.
You understand and agree that these materials may be published, displayed, distributed, or shared publicly, including but not limited to BK Music Learning’s website, social media pages, flyers, brochures, presentations, promotional materials, grant materials, newsletters, and other media platforms.
No compensation, notice, review, or further approval will be provided for the use of such photographs, videos, recordings, images, or likenesses, unless otherwise required by law or agreed to in writing.
Notice of Photography and Filming
When possible, BK Music Learning may provide notice that photography or filming is taking place during a workshop, program, or event. Attendance or participation after such notice has been provided constitutes consent to be photographed, filmed, or recorded.
Individuals who do not wish to be photographed or recorded should notify BK Music Learning staff, the hosting school, or the hosting organization before participating. While BK Music Learning will make reasonable efforts to honor such requests when possible, it cannot guarantee that an individual will not appear incidentally in group photos, wide shots, background footage, or event documentation.
Agreement to Terms
By attending, entering, observing, or participating in a BK Music Learning workshop, program, event, or related activity, you confirm that you have read, understood, and agree to this Workshop Participation, Liability, and Photo/Video Release on behalf of yourself and, where applicable, any minor child, student, or participant under your care or supervision.
Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of New York.
